Humanitarian & Compassionate Consideration ( H&C)

Humanitarian and compassionate consideration applications are very discretionary it is an exceptional measure and approval is not guaranteed. A person who applies for permanent residency must do so according to the eligibility criteria and from their own home country. However , in some cases you may request an exemption from some of the eligibility criteria on H&C grounds. To be able to apply under this category , you need to :

• Be in Canada

• need an exemption from one or more of the requirements of the Immigration and Refugee Protection Act ( IRPA) or the regulations to apply under the PR within Canada

• believe that your circumstances warrant humanitarian and compassionate considerations for the granting of the exemption

• Not be eligible for PR under any of the following categories:

  1-Spouse or common-law partner;

  2-Economic class;

  3- Protected person or Refugee class

  4- Temporary resident permit holder

You can also apply for H&C if you are inadmissible in some cases.
