Humanitarian and compassionate consideration applications are very discretionary it is an exceptional measure and approval is not guaranteed. A person who applies for permanent residency must do so according to the eligibility criteria and from their own home country. However , in some cases you may request an exemption from some of the eligibility criteria on H&C grounds. To be able to apply under this category , you need to :
Be in Canada
need an exemption from one or more of the requirements of the Immigration and Refugee Protection Act ( IRPA) or the regulations to apply under the PR within Canada
believe that your circumstances warrant humanitarian and compassionate considerations for the granting of the exemption
Not be eligible for PR under any of the following categories:
1-Spouse or common-law partner;
2-Economic class;
3- Protected person or Refugee class
4- Temporary resident permit holder
You can also apply for H&C if you are inadmissible in some cases.
